MORRIS PLAINS — A judge has found a police officer in Morris County not guilty of driving while intoxicated while on duty.

A municipal judge in Morris Plains on Tuesday found the local prosecutor could not prove Montville Officer Kurt Geisinger was operating a vehicle or intended to operate one.

A fellow Montville officer charged Geisinger in October with driving while intoxicated. At the time, authorities said Geisinger was driving an unmarked patrol car.

The arresting officer testified Geisinger said he drank alcohol in the police department parking lot. But the officer did not see him driving.

Geisinger has been suspended with pay since he was charged and faces a possible discipline hearing.

His lawyer, Denis Driscoll, told the Daily Record of Parsippany he knew the prosecution had deficiencies in its case.
