MULLICA TOWNSHIP (AP) — A south Jersey kindergarten teacher who reported two five-year-olds after they emerged from a bathroom and said they had engaged in sex play will not lose her job.

An arbitrator refused to uphold tenure charges brought against Mullica Township teacher Kelly Mascio.

The 16-year veteran is entitled to almost four months of back pay. But the arbitrator found Mascio failed to supervise her students and issued a 10-day suspension.

Mascio was suspended with pay soon after the September 2013 incident and without pay since late February.

Her lawyer, Michael Damm, tells the Press of Atlantic City his client is grateful the arbitrator determined she should be reinstated.
