This was the case that started with a road rage incident. Walker was driving his minivan on a highway in Maryland with his wife and children, ages 3, 6 and 11, when Joseph Harvey Jr. either was cut off by Walker or perceived that he was cut off by Walker.

Walker says Harvey then started menacing them. A lot of this is confirmed by a passenger in Harvey's own car by the way. Walker was trying to get away from him and whatever he did Harvey kept up, screaming obscenities and racial slurs at the black NJ police detective and his family and threatening that he was going to kill them all.

During the incident Walker says he had reason to believe something during the incident may have damaged his car. When it seemed Harvey finally drove on ahead and it was over, a shaken Walker pulled his minivan to the side of the road and got out. Walker went out not with the intention to engage Harvey but rather to check his vehicle for damage.

As he's out of the car that's when his wife started screaming that the car driven by Harvey had stopped far up ahead the highway and that he was coming on foot. Walker stood to find Harvey coming up the road fast in an aggressive manner still ranting about hurting him and his family.

At that point Walker says he identified himself as a police officer and drew his weapon. It didn't stop Joseph Harvey Jr.. He continued straight at Walker in an aggressive manner. Walker says he gave him several orders to stop, identified himself more than once as a cop. Finally, when the man was within 6 feet, Walker fired. The man died.

Walker says he was defending himself and his family. The state of Maryland says it was murder.
