ATLANTIC CITY — A man already classified as a Tier 2 sex offender sent pictures of his genitals to children as young as 9 — and at lease one sent pictures back — authorities say.

Sherman W. Miller, 49, faces a 12-count indictment on charges that include endangering the welfare of a child by causing the child to engage in sexual pornography, and failing to register as a sex offender. He also faces seven counts of third degree endangering the welfare of a child by engaging in sexual conduct with children.

Atlantic County Prosecutor Diane M. Ruberton said the arrest came after a year-long investigation by her office's Computer Crimes Unit as well as law enforcement in Texas. Miller is alleged to have sent child pornographic images to a child in Texas who is under the age of 14.

Authorities say they also found victims in seven states — Michigan, Georgia, Massachusetts, California, Missouri, South Carolina, and Mississippi. In those incidents, Miller is alleged to have sent pictures to minors ranging from 9 to 14 years old.

Miller also faces one count of third-degree failing to register as a sex offender, and one count of third degree failing, as a registered sex offender, to register a change of address with 10 days of that change.

In 1995, Miller was convicted of aggravated sexual assault. His address, according to the New Jersey State Police registry, was Ohio Avenue in Atlantic City.

Miller is being held at the Ocean County Justice Facility lieu of $50,000 cash bail with no 10 percent option. If convicted of the first-degree crime Miller faces between 10 to 20 years in prison. A conviction on the third-degree charges carries a sentence of three to five years.
