BURLINGTON — A judge has denied a motion by Assemblywoman Maria Rodriquez-Gregg to keep key evidence out of her DWI trial and dismiss her case.

NJ.com reported that Burlington County Judge Dennis McInerne ruled that there is "credible evidence" that the 8th district Republican drove her car after having alcohol the night in April she was rear-ended in Mount Laurel.

Rodriquez-Gregg's lawyer contended that because she didn't complete all the required forms, a sample of her blood was taken that night without her consent. McInerne ruled there is no evidence she was forced into giving the sample.

The night of the incident, officers told her they smelled marijuana and wanted to search her car, setting off a profanity-laden tirade by Rodriquez-Gregg. Rodriquez-Gregg said she had smoked cigars earlier in the evening at an event in Moorestown.

She told officers on the scene at least three times that she is an assemblywoman and at one point complained that she was being treated harshly as a Latina. She repeatedly argued with officers, saying she was calling her attorney and that she did nothing wrong.

Her attorney told The Trentonian that no marijuana was found in her system, but a “borderline” amount of alcohol was. Ultimately, officers found no marijuana in the car.

Rodriguez-Gregg did not run for re-election this year due to "personal matters," and will leave office in January.

The exchange was caught on the police officers’ bodycams. A copy of the footage was obtained by The Trentonian, which published the video. An abridged version published with the Trentonian’s permission is above.

“I got rear-ended and you guys are treating me like I’m the f***ing a**hole,” Assemblywoman Maria Rodriguez-Gregg tells officers, who don’t seem to realize she’s a state official.

“You’re dealing with a sitting assemblywoman. Everyone’s going to hear about this sh–.”

Rodriguez-Gregg, 35, who wacis rear-ended by an out-of-state resident, was charged with driving while intoxicated and obstruction.

In the video, officers are heard telling each other that they had detected the odor of marijuana coming from Rodriguez-Gregg’s car.

“Oh my God. There’s no marijuana in my car. I smoked cigars earlier [..] in Morristown. But there’s no marijuana,” she tells him, agreeing to a search of her, which she retracts moments later.

“Are you serious right now? I’m a sitting assemblywoman. Do you think I’m f***ing smoking cigars — oh, I’m sorry – smoking marijuana at this time of night? I’m calling my lawyer,” she tells the officer. “Is that what they said? These people who f***ing rear-ended me?”

“Not at all,” the cop replies.

“That’s bull****!”

The lawmaker grows angrier after an officer asks her to get out of her car and asks her if she had “anything to drink tonight.”

“I’m being harassed by the police,” she says during a tirade in the middle of the road while speaking to someone on her phone who she says is her lawyer. “I have done nothing but support the police. I have been your No. 1 supporter politically. F***ing assholes!”
