A wealthy New Jersey shore enclave's attempt to opt out of a protective sand dune plan in an area devastated by Superstorm Sandy was turned down by a judge Wednesday, while a decision to allow a similar project to proceed in another part of the state was upheld by a federal appeals court.
The ponds of standing water were exactly what Margate residents had warned of in previous, unsuccessful litigation against the government's plan to build the protective sand dunes there.
Officials in Margate will decide whether to seek a court injunction to halt half-finished dune work that has caused huge ponds of standing water on the beach.
