A New Jersey judge has ruled that a lawsuit can go to trial in the case of a boy who suffered brain damage after being struck in the chest by a line drive off a metal bat while playing baseball.

The Record reports that the lawsuit filed by the family of Steven Domalewski claims Kentucky-based bat maker Hillerich & Bradsby Co., national retailer The Sports Authority, Inc.; Little League, Inc.; and New Jersey Little League are responsible for their son's injuries.

Domalewski, of Wayne, was 12 years old at the time of the 2006 incident.

Hillerich & Bradsby has denied the claims. Little League Inc. has said that there is no evidence aluminum bats are more dangerous than wooden ones.

The trial is set for Sept. 10. in Paterson.
