K-mart Pays for Expired Goods

New Jersey officials say retail giant Kmart has agreed to pay more than $300,000 in penalties after state inspectors found expired infant formula and non-prescription medications being sold at 19 stores. The Division of Consumer Affairs says Kmart will pay $302,500 in fines and the cost of inspections, as well as donate $25,000 worth of infant formula to charity.

A spokesman for Kmart says the retail chain cooperated with investigators, takes customer safety seriously, and has implemented additional safeguards to ensure they don't sell expired products.

State consumer affairs officials say inspectors found a total of 257 packages of infant formula and non-prescription medications past the expiration date at stores in Atlantic, Bergen, Burlington, Camden, Cape May, Essex, Gloucester, Mercer, Monmouth, Morris, Ocean, Passaic, and Somerset counties.
