Should Shannon Colonna be Liable for Sending Text Message that Caused Kyle Best To Crash? [POLL]

Shannon Colonna is being sued for sending a text message to Kyle Best that he read while driving and caused an accident which resulted in a couple each losing their left leg. This case, if successful could turn the world of texting on it’s ear.

If this suit is successful, it could set a precedent where you could be liable for any text you send depending on what the recipient is doing while reading it. Best is clearly wrong for texting while driving, he’s under no obligation to read and reply when he did and Colonna  shouldn’t be held responsible if he does. The next step from here could be if you’re on the phone with someone driving who gets into an accident. Should you be held responsible for the person reading your text?
