How do you feel about the possibility of legislation passing that would make it a lot easier to convict a driver of vehicular homicide if they were illegally using a cell phone at the time of a fatal accident? Should the charge depend on what you were doing on the phone at the time?

I've always thought that holding the phone up to your ear was not nearly as distracting as looking down to send a text message or email. Should that translate into a lesser charge if you happen to be on the phone speaking with your kids?
