NEW BRUNSWICK — No charges will be filed against the man caught slugging Emily Rand in the face with a right hook so hard that she was knocked unconscious when her head hit the sidewalk.

"We've finished our investigation and interviewed the individual you see in the video, as well as a lot of other people. A this time there's not going to be any arrests or any charges," New Brunswick Police Capt. J.T. Miller told New Jersey 101.5 of the incident that took place around 1 a.m. Saturday, Oct. 29. "It's a mutually exclusive fight between the individuals."

The incident was captured on video, which was posted online.

Miller said that the 19-year-old Middlesex County College student from South Amboy struck the man first and "there is evidence that she was aggressive towards other people before the video starts."

Other people involved with the video do not want to pursue charges against Rand, according to Miller, who did not disclose the identity of the man.

Rand has been at Robert Wood Johnson University Medical Center and was in a coma following skull surgery to relieve pressure in her swollen brain.  Her aunt, Debbie O'Connor, said Rand has started to breathe on her own this week and will soon begin physical therapy.

A short video of the incident captured on a cell phone shows a loud crowd watching as a  blond female punches a man dressed in a gray sweatshirt with black and white sleeves and a black baseball cap on Hamilton Street near Rutgers University. He then punches her hard and she falls straight back onto the sidewalk. Someone leads the male away from the scene, leaving the motionless woman behind.

“I don’t condone her throwing the first punch. If he grabbed her and just held her it would have been OK,” O'Connor said last week.

Miller said they knew who they were looking for and the man was not hiding from police.

"We met with him and interviewed him."

Rand works at the Macaroni Grill restaurant.
