Marathon Suspect Will Be Tried In Federal Court [VIDEO]

On the one-week anniversary of the Boston Marathon bombings, the White House says suspect Dzhokhar Tsarnaev not be tried as an enemy combatant.

The decision means that Tsarnaev will be read his Miranda rights which he was not read when he was arrested in a Watertown, Massachusetts backyard boat on Friday night.

A court official says the surviving suspect in the Boston Marathon bombings is facing federal charges and has made an initial court appearance in his hospital room.

 

The charges against the 19-year-old  remain sealed. The US Attorney’s Office Disttrict of Massachusetts tweeted that Dzhokhar Tsarnaev is being charged with conspiring to use weapon of mass destruction against persons and property in U.S. resulting in death.

Gary Wente is circuit executive of the 1st U.S. Circuit Court of Appeals. He says the suspect made his first appearance before a magistrate judge Monday afternoon in Beth Israel hospital.

Meanwhile, the FBI says Tsarnaev remains in serious condition at Beth Israel Deaconess Medical Center in Brookline, Massachusetts. CNN reports that Tsarnaev is answering questions by nodding his head. He has been asked if there are more explosive devices and if anyone else was involved in the Marathon bombing plot.
