Amtrak has reached a settlement with a former convict who was taken off a train in southeastern Colorado and arrested after a fellow passenger thought she heard him make threatening statements.

Ojore Lutalo sued Amtrak and the city of La Junta after his arrest in 2010 as he headed home to Elizabeth, N.J.

Prosecutors found he didn't make any direct threats and didn't file charges. Lutalo's lawsuit alleged he was targeted for arrest, partly because he is African-American and that his civil rights were violated. He previously settled with the city.

Court documents show the Amtrak lawsuit was dismissed this week following settlement talks. Each side is paying its own attorney fees and costs. Other settlement terms weren't disclosed.

Attorneys didn't return messages seeking comment Wednesday night.
