US Supreme Court Won’t Hear Fort Dix Plot Appeal

The U.S. Supreme Court will not hear an appeal filed by five Muslim men convicted of planning to attack Fort Dix or other military bases.

The decision was disclosed Wednesday by Richard Sparaco, a lawyer for one defendant. No reason was given.

The men -- Mohamad Shnewer, Serdar Tatar, and brothers Dritan, Eljvir and Shain Duka -- were arrested in May 2007. In 2008, a federal jury in Camden convicted them of conspiring to kill U.S. military personnel at Fort Dix.

The five are Muslim immigrants who grew up in the New Jersey suburbs of Philadelphia. All but Tatar are serving life terms.

Defense lawyers had questioned prosecutors' use of wiretaps obtained under the Foreign Intelligence Surveillance Act, claiming it was unconstitutional to use them in a domestic criminal case.
