State appeals court invalidates shore town’s parking plan

POINT PLEASANT BEACH (AP) — A state appeals court has invalidated a Jersey Shore town's parking ordinances.

The ruling is the latest in a two-year-old battle in Point Pleasant Beach. The borough passed ordinances that restricted overnight parking on some roads to cars with placards provided to residents.

It later expanded the area covered by that ordinance. So several individuals and fishing charter companies sued to stop the ordinances.

A lower court judge rejected the ordinances, noting a borough council member had a conflict of interest because he was a realtor in the affected area. The borough then passed a new ordinance, and this time the judge ruled in the borough's favor.

But in a ruling published Monday, the appeals court said the ordinance was invalid because there weren't enough affirmative votes to pass it.
