Joe Giudice is set to appear in Passaic County court Wednesday at 11 a.m. on state false identification charges. He is accused of using his brother's identity to obtain a driver's license while his own license was suspended for driving while intoxicated in 2010.

He was sentenced to 41 months in prison on the federal charges while his wife, Teresa, was sentenced to 15 months.

The Record reports that a Passaic County assistant prosecutor said at a hearing last month that the case will likely be resolved by a plea deal. The deal would include a prison term that runs concurrently with the federal sentence.
