A pro-marijuana activist known as NJ Weedman won't be sent to jail for possessing a pound of pot.

A New Jersey judge on Wednesday sentenced Ed Forchion  to two years of probation and $3,400 in fines. He also said that Forchion can serve the probation in Los Angeles, where he now lives.

The 46-year-old activist was convicted by a jury in October of pot possession. He was acquitted of more serious drug distribution charges that could have gotten him 10 years in prison.

He argued that criminal and medical-marijuana laws are inconsistent.

Forchion plans to appeal.

He says he shouldn't have been prosecuted at all because he qualifies for medical marijuana in California for a rare bone tumor disorder.
