A man suspected in the deaths of a woman and her 2-year-old son whose bodies were found in a basement apartment on New York's Long Island will stay in Maryland for now after refusing to waive extradition to New York.

Jerry A. Lewis of Englewood, N.J., refused to waive extradition at a hearing Tuesday. The 24-year-old will have a second opportunity to waive extradition at a Jan. 27 hearing where a judge will also get an update on the progress of the case.

New York now has to petition Maryland for Lewis' return. It could be 60 to 90 days before it is determined whether he must go back to New York, which is likely.

Lewis is being held without bond. It was not clear if he has an attorney.
