State environmental officials have denied a request to delay the takeover of a northern New Jersey landfill they say failed to control a stinky gas odor.

Environmental Protection Department accuses the company that owns the Fenimore Landfill in Roxbury of failing to follow procedures that led to high levels of a rotten-egg smelling gas to be released. Neighbors complained it made them sick.

A lawyer for the landfill company, Matthew Fredericks, says it did use various methods to control the gas but the DEP never accepted them or other suggestions.

The DEP seized the site on Wednesday within an hour of Gov. Chris Christie signing legislation that gave the agency the power to do so.
