A state appellate court has upheld a lower court ruling that a child living with her Turkish father in Clifton, N.J., must be returned to her mother in Turkey.

The Record reported Tuesday's ruling, saying the mother's attorney, Amy Sara Cores, told the paper she planned to seek a court order Wednesday allowing Cores to take the girl back to her mother. The parents and the child were not identified in the court decision. The paper said the father's attorney could not be reached for comment.

The paper said the child was born in the U.S. when the parents were on vacation. She was 5 when her father brought her to the U.S. in 2008.

A judge ruled last year that the girl had been wrongly taken from her mother.
