Man shot dead while breaking into NJ home, authorities say
No charges will be filed against a Cumberland County resident who shot a man inside his home in March.
Cumberland County Prosecutor Jennifer Webb-McRae in a statement says investigators found "clear forensic evidence" that Brian Delvecchio, 52, of Millville, "was clearly attempting to gain unlawful entry into the home" on Hogbin Road in Lawrence.
Police were called to the home and found Delvecchio dead with a single bullet wound to the chest.
Citing New Jersey state law about use of force in self protection, Webb-McRae said "Mr. Delvecchio's death, while unfortunate, was not the result of criminal conduct which can be proved beyond a reasonable doubt."
The prosector's office will not identify the shooter "in order to protect the privacy of potential victims of violent crime."
