The Linden police office who was the driver in a Staten Island car crash that took the life of two people is still able to drive.

NJ.com reports that Officer Pedro Abad still has a valid drivers license with no points against it or pending and no mention about the March accident that took the lives of officer Frank Viggiano and friend Joe Rodriguez while officer Patrik Kudlac was critically injured.

Staten Island prosecutors say Abad had a 0.24 blood alcohol level during the head-on crash but did not receive a ticket for the incident.

Abad was indicted on manslaughter charges, according another report on NJ.com, and will formally be charged on Monday with aggravated vehicular homicide and vehicular manslaughter. According to his lawyer, Mario Gallucci , Adbad will plead not guilty to all charges.

Galluci says that Abatd is getting around with help from a wheelchair because of damage to two legs that he will have additional surgery  to. He does not have use of one arm and speaks with an impediment because of  "diminished mental capacity" but is aware of the case.
