New Jersey's U.S. attorney's office announced Tuesday that the criminal indictment against Dave Herman had been dismissed as a matter of procedure following his death on May 29. Herman, who was 78, died after being taken to the hospital from a New Jersey jail where he was being held on a charge of attempting to transport a 7-year-old girl to the U.S. Virgin Islands for sex.

The Essex County prosecutor's office says the medical examiner has determined that Herman died of natural causes from a cardiac-related incident.

Herman had been living in St. Croix, where he was arrested in October.
