WAYNE (AP) — State authorities claim the owner of two north Jersey auto dealerships used deceptive advertising practices and engaged in "bait and switch" tactics

The five-count complaint against Bergen Auto Enterprises LLC was announced Tuesday. The company operates Wayne Mazda and Wayne Auto Mall Hyundai, both located on Route 23 in Wayne.

The state claims the company failed to tell consumers that used vehicles had been used as rentals or that used vehicles had sustained significant prior damage. It also says the firm featured vehicles in advertisements that were not available for purchase or lease and didn't publish statements to consumers about applicable purchase costs.

The state seeks restitution for affected consumers and civil penalties against the firm.

A company spokesman was not immediately available for comment on Tuesday.
